If Voting ever changed anything, they'd make it Illegal... Enter the Three Trump appointed MAGA Fascists of the Odious 5th Circuit

3 Republican Judges of the 5th Circuit Court of Appeals have ruled it is illegal to count ballots in Mississippi because when people vote, Republicans lose.

With deplorable shit-eating grins these 3 MAGA Fascist Injustices declared,

Congress statutorily designated a singular ‘day for the election’ of members of Congress and the appointment of presidential electors.  Text, precedent, and historical practice confirm this ‘day for the election’ is the day by which ballots must be both cast by voters and received by state officials.

As Lawyers, Guns, and Money have so often stated about Republican Judges this is an argument from Seinfeld, that the Card Says Moops.  These type of Bureaucratic Coups using legalese and byzantine wording of laws receive scant news coverage other than the day the ruling is received but, are big source of successful efforts of Republican voter suppression and disenfranchisement.

Steve Vladeck believes this bullshit decision won't actually come into play this election cycle, but, is designed to give John Roberts and the insidious Six Supremacist Judges a chance to strike down key parts of the mail-in voting, which are used by 18 States and Washington D.C.

And in fact the MAGA Fascists Judges James Ho, Kyle Duncan and Andrew Oldham of the 5th Circuit do close their brief with the Wash their Hands Clean excuse, Today's decision says nothing about remedies.  We decline to grant plaintiffs' request for an immediate injunction...

And the three Judges then made a sop to the Sinister Six Injustices of the Surpemacist Court by referencing Boofer O'Kavanaugh's anti-democracy ruling,

As Justice Kavanaugh recently emphasized: “To state the obvious, a State cannot conduct an election without deadlines . . . A deadline is not un- constitutional merely because of voters’ own failures to take timely steps toensure their franchise.” Democratic Nat’l Comm. v. Wis. State Legislature, 141 S. Ct. 28, 33 (2020) 

As, the too cool for school Gen X saying goes, "If Voting ever changed anything, they'd make it Illegal..."  John Roberts, especially, has worked his entire career to making voting harder, less accessible, and more difficult because Republicans don't want you to vote and don't want you to have a voice in any portion of the United States Government.

Like all Republicans John Roberts, and his toady 5th Circuit believes the United States should be a Neo-Feudal White Supremacist Ehtno-State.  From now until Tuesday Nov 5th you still have a chance to vote and to have your vote count.  But, like cackling jackals and rapacious hyenas Project 2025 and MAGA are waiting for you to let your guard down so they can snatch your Franchise from you and create the Fascist Fundamentalist dystopia  of their dreams.

The Supremacist Court rules when Trump does it, it is not illegal

I wrote before that Traitor Trump broke The Law in a fundamental way.  Well, the Sinister Six of the Supremacist Court just declared any "Official Act" of Traitor Trump axiomatically confers Immunity.  And what is an "Official Act"?  Why anything we say it is, up to and including overthrowing the United States Government.

The Trump Immunity ruling was just one of multiple decisions from these 6 Feudal Overlords completely making a mockery of the heralded Rule of Law...

A Nation of Laws, not Men... nonsense.

The Majesty of the Law... pure sophistry.

"The Law" is whatever Republicans say it is anyone hoping guardrails and Institutions will protect us as they barely fucking did during Trump's first reign is fooling themselves.  The 6 Injustices have taken power in this Nation and their goal like all Republicans is to Rule or Ruin.  If they can't have control of all levers of power well they will make those levers unusable, inaccessible, or unenforceable. 

Most people don't pay attention to the Supreme Court at all and this won't get the Corporate Media headlines (like wall-to-wall coverage of BIDEN DROP OUT got) because Corporate Media serves Corporate Interests.

The reality is most people will be unaffected (at first) so they won’t do anything in response to what is coming.  Eventually, people might recognize things suck for them as companies simply violate clean air and water regulations or clear cut National Parks but, that's when the Rightwing Media Machine will kick into high gear and blame the Immigrants and Transgenders for American's woes.  Those few individuals who do feel that resistance is called for will face the full fury of the Federal law enforcement apparatus without all of Trumps special privileges.

John Roberts has laid the foundation for an American military dictatorship.  Trump, or more accurately his cabal of vile acolytes have a plan to institute the monstrous regime.  I still have hope that the ground-level Police Officer, National Guardsman, or Army Reservist will balk at orders to round-up and execute millions of people but, that is a slender thread to rest the Soul of the Nation upon.  Most people due to personal fear, lassitude, or animosity will go along with what's ordered because hey Trump's President therefore what he (or more precisely Stephen Miller) is ordering is perfectly legal and didn't the Supreme Court rule Official Acts confer immunity?

Understand the playbook is the same as it always is for Fascists.  They'll target the weakest or the most maligned and powerless segments of society;  undocumented (Hispanic) immigrants and the members of the LGBTQ+ community.  But, it never stops there and already the rules and "laws" are in place to enslave women.  Republican controlled States are already enforcing Christianity and melding Church and State.  Even your 1st Amendment rights are contingent on the Surpemacist Court's give-and-take shell game.

Right now, all isn't lost.  But, even if Joe Biden pulls off a win in 2024 we are balanced on the knife's edge of America becoming a full-fledged Fascist Ethnostate.  Don't give in to despair.  I acknowledge your feelings and fears and share them.  But, we can stave off defeat in November 2024.  And then fight day-to-day to keep a winning streak going.

The Democratic Party in Illinois moves to protect Waterways & Wetlands

 Last year, the scummy SCOTUS ruled that the US Constitution and Clean Water Act aren't valid because the Supreme Six Injustices deem it to be so.

The fact the Clean Water Act was 50 years old or the that the first legal cases decided by the old SCOTUS dates back 200 years ago, or that the right of the Federal Government to regulate waterways is written into the very Constitution is irrelevant;   The Scummy Supreme Six Injustices are aligned with the rapacious Rich and those who despoil the Nation.

The Clean Water Act of 1972 survived decades of litigation from opponents seeking to limit the authority of federal agencies like the U.S. Environmental Protection Agency and U.S. Army Corps of Engineers to regulate the Waters of the United States, typically referred to as WOTUS. Before the wetlands decision, the Supreme Court upheld the definition of WOTUS to not only include navigable bodies of waters but also adjacent wetlands with meaningful hydrological connections. 

For over a decade, Michael and Chantell Sackett, an Idaho couple, challenged this definition before the Supreme Court twice. In 2004, they bought a lakeside property with the plans to build a home on the site. The couple began excavation without applying for the appropriate permitting to develop on top of a wetland and the EPA stopped the project. 

Last May, in a 5-4 ruling, the Supreme Court ruled in favor of the Sacketts.

You might have missed this ruling seeing as the Reactionary Court has been pushing through all manner of regressive bills designed to return the United States to its' Roots as a Slave Owning Kleptocracy built upon white supremacy and fundamentalist hyporcisy but, the Injustices financial backers and benefactors also have a eye on undermining any regulation which stymies their ability to despoil the land, strip it of it's natural beauty and reap the financial rewards.

All the meanwhile, leaving behind a shattered wasteland to be inherited by the meek.

Fortunately, here in Illinois we have a Democratic Legislature which will not simply turn the rivers, lakes, streams, and wetlands over to rapacious billionaires to do with as they wish.

In response to another unjust overreach by this Court, Illinois State Senator Laura Ellman introduced a New Act 30 ILCS 105/5.1015, the Wetlands and Small Streams Protection Act:

to restore protections for wetlands and small streams that were formerly protected from pollution and destruction by the Clean Water Act. Provides provisions concerning: exemptions; wetlands delineation, classification, notification, permits and veto; general permits; appeal of final decisions made by the Department of Natural Resources and judicial review; investigation and enforcement; and county authority. Creates the Wetlands and Small Streams Advisory Committee and establishes duties and rules for the Committee. Creates the Wetlands and Small Streams Protection Fund. Provides for permit review fees. Defines terms. Makes conforming changes in the State Finance Act and the Illinois Environmental Protection Act. Effective immediately.

Marshes, bogs, ponds, streams, and other waterways are not things to be drained, damned, or reclaimed but integral pieces of a functioning landscape, a refugee for wildlife, and repository of natural beauty.

But, the 1% won't be satisfied with the massive gains they've made over the rest of America; the Rich want it all, which is why they know if they put Trump back into power they'll be able to finally eliminate the Middle Class, end the American dream, and shackle the American people into perpetual wage slavery and bondage.

A key component of Fascism is the unequal application of laws; there are individuals and groups who are above the law and their are groups and individuals who are subject to full weight and force of law.  

This is usually summed up in the Social Media age with the following quote; "There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect."  This misattributed quote has an interesting backstory.

Typically in America, Race has been the deciding factor for two-tier justice system. Running parallel to Race is Class in the system which railroads some people and provides all manner of excuses for their behavior, second third or fourth chances, and finds all sorts of reasons to not bring the law to bear upon them.

Conservatives have often been given a large leeway in the commission of crimes that rightwingers are aghast that many are being held responsible for their criminal actions on January 6th.

Some of the Jan6th plotters have found a nice loophole to evade arrest and prison; these are the powerful Republicans at the Federal level who participated, facilitated, and conspired in the Republican attempt to overthrow the United States Government.

One of those deeply involved in the Plot to Destroy America was Ginni Thomas, who when not drunk was texting multiple members of the Executive branch with ideas, plans, and schemes to undo the election of President Joe Biden.  This information was kept from the American people for a year and half, while Ginni plied her husband Supreme Court Justice Clarence Thomas to enact regressive fascist rulings via Judicial Fiat to oppress and shackle the American people in the Republican effort to create the NeoFeudal Dictatorship built upon corporate bondage and a strictly enforced social stratification system based on religion, race, and wealth.

But... let's recall the leaked Dobbs decision from May of last year.  Faux News did dozens of segments intimating that liberal clerks for the liberal Justices leaked it.  Slimy Ted Cruz took time off from destroying evidence of his involvement in the attempt to overthrow the US Government he supposedly swore an Oath to Protect and Defend to claim that all liberal Justice Clerks should be summarily arrested and interrogated in violation of the 4th Amendment because Ted Cruz doesn't adhere to the Law in the United States.  But, the initial theory that Sammy Alito or Ginni Thomas leaked the ruling in order to ensure John Roberts didn't go limp and try and convince Boofer O'Kavanaugh to not outright cancel Roe but, continue the slow reactionary process of slicing it up ruling after ruling until poof one day it was gone seems to be correct.  Alito was most likely the Leaker.  So, instead Alito and his Supremacist Court decided this was their opportunity to begin making Women second class citizens in the United States.

But, after Injustice Roberts declared the leak a "betrayal of the confidences of the court" and vowed to Find the Leaker we are now witness to the next stage of the Farce of the Supremacist Court, sadly the Leaker has not been identified and no reason to look any further; onward towards dismantling the United States via 6 unelected politicians in robes.

At this time, based on a preponderance of the evidence standard, it is not possible to determine the identity of any individual who may have disclosed the document or how the draft opinion ended up with Politico.

And the electoral fallout from Alito giving the Vaffanculo wasn't too bad for Republicans and so now comes the next steps, slowly have rightwing states outlaw abortion, arresting doctors, intimidating delivery services, and punishing women.  Women will die and conservatives will cheer.  Predictably Republicans and religious groups, like the Thomas More Dead Women Society, are clamoring for the Court to step in and restrict Abortion Nationwide and await the chance of the US Government Trifecta in 2024 to pass the Ultimate anti-abortion law stating Women are Property.

ETA: And apparently Gym Jordan and the Republican House is going to investigate the leak once they get tired of looking at Hunter Biden dic pics.  Which means plenty of minor Democratic officials and judicial clerks are to be dragged in front of Major Traitor Greene and Matt "All the 14 Year Old Girls Belong to Us" Gaetz to threaten them and release their names and addresses to Tucker Carlson for proper excoriation and death threats from Proud Boys. 

Texas has declared War on the United States is trying to overthrow the Federal Government

Seriously, when Ted Cruz or Greg Abbott threatened to secede from the Nation we should have taken them up on their offer.  Get your fanatic fascist asses the fuck outta here. 

Asshole Texans kept taking to social media to demand people stop Californiaing their Texas (because rightwingers are drones who have no imagination they all repeated that comment).  Well, stop Texasing Up my United States.  Honestly, without the civilizing influence of the liberal states, Texas would be Saudia Arabia, Iran, or Russia, a brutal inhumane pariah nation which only gets attention because of its' resources.

Certainly, we should demand Texas reimburse the United States for absorbing their National Debt of over $10,000,000 in 1836 adjusted for inflation and with interest applied and demand repayment for all the infrastructure we've built in that shithole State.  Texas has been at the forefront of advancing fascist rollbacks of human rights in their quest to be the shittest of the shithole States.

President Biden issued a decree which says too bad your vile State Law outlawing necessary medical care for women is not legal and does not trump Federal legal supremacy.  In response, known criminal Ken Paxton, who flouts laws and gets away with it by being powerful white Republican male, filed a lawsuit against the Federal Government filled with all the agitprop conservatives have been fed to hate "Big Government";

President Biden is flagrantly disregarding the legislative and democratic process—and flouting the Supreme Court’s ruling before the ink is dry—by having his appointed bureaucrats mandate that hospitals and emergency medicine physicians must perform abortions. 

What a load of Texas Bullcrap.  Conservatives actually love Big Government it's just they expect and want a government that afflicts the afflicted and comforts the comfortable.  They want a federal government which brutally oppress minorities, sanctions women into second class citizens, and ensures that white male evangelical hegemony is ensconced into law.  Tough Talkin' Texans no longer threaten Secession because they've decided upon Subjugation.  Through multiple levers of bureaucratic violence Republican dominated states are exerting their will across state boundaries and obviously upon niches of the Federal Government.    

Bureaucratic Violence is precisely what the Sinister Six Supreme Injustices provided Republicans as a weapon against Americans when they banned Abortion but, the Opus Dei Supremacist Court opened up a whole bunch of cognitive dissonance as well.  The mythical centrist can't believe the Republicans would actually institute total bans on abortions, as several states have done, even when the woman's life is in danger, the pregnancy is terminal or unviable, or the victim of a horrendous crime is a 10 year old child.

It must never be forgotten this is a key component of Fascism.  Deliberatly, lying and creating these untenable situations and expecting the victim of you policies to adapt or interpret your will is a key lever of power Reactionaries use.  Reactionary politics which arose in direct response to the liberalizing influences of 18th and 19th century political thought abuses the open society created by democracy and turn their opponents empathy against them.  For over 100 years, liberals have struggled in response.

The Supremacist Court and Republican Party 2022: End Women's Suffrage - Start Women's Suffering

It isn't theoretical anymore.  The prospect of women being in excruciating pain and dying from complications from pregnancy is precisely what Republicans want women thinking about.

Capitol Fax posted fallout for women in the states surrounding Illinois.  The idea that a woman comes into a Hospital needing emergency services but, Doctors are too afraid to treat her for fear of Republican zealots coming for them financially, rhetorically, and physically shows what Republicans have in store for Us all eventually but, also and most importantly what is happening Right. Damn. Now.

Kristi Noem was interviewed by Martha Raddatz, and for once a Corporate Media did not let a vile Republican Governor elide answering questions.  Raddatz pointed out South Dakota now has a total ban on abortion including all cases in which the fetus is unviable and the women will die.  Raddatz continued that South Dakota has no assistance or post natal care and Noem, in her dead eye stare kept talking about how her state would walk with mothers and touted the website they created to help.  Noem then unknowingly admitted that non-profits and churches would be tasked with most of the help.  But, it was Noem's loaded phrase she does not "anticipate" South Dakota will take up proposals that incentivize residents to report women suspected of seeking or aiding in abortions which was most chilling and indicative of the fascist future.

This is an exercise in sheer naked aggression and power.  Very much in line with the Rape-publican Party 

Also, now comes the time when the so-called Originalist Court and the rightwingers who falsely profess to adore and cherish the Constitution to throw out the Freedom of Movement clause.  Republicans are going to pass legislation that the unique nature of abortion (especially since it infringes on their religious liberty) necessitates the need to create internal border checkpoints, that women seeking to travel outside their states need to show proof of negative pregnancy test (ha take that libtards just like your Covid restrictions!) and empowers them to curtail 200 years of legal reasoning and ruling with regards to freedom of movement. 

Then it's only a matter of time until the Puzzi Alito Court looks at 1920 Womens' Suffrage as being incompatible with the Originality of the Constitution and "not deeply rooted in the Nation's history and traditions."  In fact, let's take a direct statement from Alito Dobbs unjust ruling and change 3 words;

• “The inescapable conclusion is that a right to women's vote is not deeply rooted in the Nation’s history and traditions. On the contrary, an unbroken tradition of prohibiting women's voting on pain of criminal punishment persisted from the earliest days of the common law until 1920.”

Today, The Supremacist Court just ruled to curtail the EPA.  If you think the Republicans will stop you're deluding yourself.  The Republicans feel emboldened, they know they can blame Biden for everything, they can act with impunity because they have the Police Forces across the Country to "dispassionately" enforce the Supreme Court's Will (i.e. Officers festooned in their best Judge Dredd regalia beat, tase, and gas unarmed women under the guise of law&order), while Mark Levin, Laura Ingraham, Ben Shapiro, Jonathan Turley, and any number of skeevy on-line trolls will feed buckets of lies and obfuscate furiously to keep conservatives placid, fat, and happy that they are Owning the Libs.  They've been yearning for this moment and are enjoying every single second. 

Republicans are coming for every right to self determination for the poor and oppressed, every progressive gain to curtail the rapacious Corporate domination of the USA, and every protection from the power of religious bigotry and oppression.  They are coming for it all.  And the Republicans won't stop until this is a White Power Theocratic Slave State again.
